Acceptance

These terms govern the use of vincentvangoghpaintings.com, published by Zundert Editions, and the purchase of paintings from Vincent van Gogh Paintings by Art & See. Using the site means accepting them. If you do not accept them, do not use the site.

Who sells the paintings

Paintings on vincentvangoghpaintings.com are sold by Art & See under the name Vincent van Gogh Paintings by Art & See. Your order is a contract with Art & See, and the charge appears on your card statement under a descriptor that begins with ART&SEE.

What you are buying

Each painting is a reproduction painted by hand, in oil, by one of our artists, from an image of the original. It is not the original work and it is not by the original artist. It is made to order, after you buy it.

Brushwork, texture and colour will differ slightly from the original and from the image on your screen. That variation comes with a painting made by hand and is not a defect. Screens show colour differently, so no image on this site can promise an exact colour match.

Prices and payment

Prices are in US dollars and include shipping to a single address anywhere in the world. They do not include import duties or taxes charged by the country of delivery: the buyer is the importer of record and pays them.

Payment is taken at checkout and processed by Stripe. An order is confirmed once payment is. If a price or a description on the site turns out to be wrong, we may cancel the affected order, even after it is confirmed, and refund it in full.

Production, approval and delivery

A painting usually takes 2 to 3 weeks to make, up to 4 weeks for complex pieces and up to 8 weeks for large ones. Before it ships you receive a photograph of it, and it ships once you approve that photograph. Approving it confirms how the painting looks. Cancellations and returns

You may cancel within 24 hours of ordering for a full refund. After delivery, the Returns page on this site sets out what can be done within 90 days, and it forms part of these terms. Frames are final sale.

The version of these terms and of the Returns page in effect when you place an order is the one that governs that order.

If something is wrong with an order, write to info@art-and-see.com before opening a dispute with your bank or card issuer. It is almost always the faster way to have it put right.

The paintings are free. Three other things are not.

Vincent van Gogh died on 29 July 1890. Every jurisdiction that measures copyright from the author's death — seventy years in the European Union and the United Kingdom, fifty in much of the rest of the world — released his work long ago, and works published before 1929 are in the public domain in the United States as well. There is no country in which one of these paintings is still protected as a painting. This catalogue can state that flatly, which a catalogue of a subject rather than a person cannot.

Three things remain protected and are regularly mistaken for the paintings. The first is the photograph: some institutions assert a copyright in faithful reproductions of works they hold, a right courts in the United States have declined to recognise and which differs by country. The second is trade mark. Museum names and logos are registered marks, and using one on a product implies an endorsement whatever the copyright position of the painting. The third is any modern derivative — a crop, a recolour, an animation, a print design — which is a new work owned by whoever made it.

Zundert Editions is an independent publisher. This site has no affiliation with, endorsement from, or connection to the Van Gogh Museum, the Vincent van Gogh Foundation, the Kröller-Müller Museum or any other institution named in these entries. Naming a collection as the holder of a work is a citation, not a claim of association. Rights enquiries go to letters@vincentvangoghpaintings.com.

Using the catalogue text

Catalogue facts — a date, a support, a set of dimensions, the name of a collection — are facts, and facts are not owned by anybody. Take them and use them.

The written text of this site is a different matter: it is the work of Zundert Editions and is not offered for republication. Quote it, cite it and link to it freely. Do not copy pages wholesale, and do not feed the site to a scraper that reproduces it elsewhere as though it were its own.

Dates, attributions and what they are worth

Dates given here follow the holding institution and the published literature, and where those disagree the entry shows the disagreement. Attribution is not settled by this site: works move into and out of the accepted corpus, and an entry appearing on these pages is a record of published status, not an opinion that a painting is autograph.

Nothing here may be relied on to authenticate a work, to establish provenance, or to support a valuation, an insurance claim or a sale. Authentication is a matter for technical examination at a specialist institution, and this catalogue neither performs it nor substitutes for it.

No warranty, and limits on liability

The site is provided as it is. No warranty is given that it will be available, that it will be free of error, or that it is fit for any particular purpose. Links to other sites are provided for reference and imply no responsibility for what is on them. Paintings you buy are covered by the sections on orders above and by the Returns page.

To the fullest extent permitted by law, no liability is accepted for indirect or consequential loss arising from use of the site, including loss arising from reliance on anything published here. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, where such a limit would not be permitted.
